New penalties & fines for non-compliance

Here is a comprehensive list of all the new penalties and fines for non-compliance with the 2023 Emiratisation targets.

Emiratisation Target
Firms with 50 or more employees are mandated to raise their Emiratisation rate by 2 per cent of overall skilled jobs. Starting January 1, 2023, those who fail to comply will have to pay Dh6,000 per month for each Emirati who is not employed.

Up to Dh120,000 fines for UAE companies violating Emiratisation rules

False Reporting
False reporting on Emiratisation to get Nafis benefits, an administrative fine of between Dh20,000 and Dh100,000 is imposed for each Emirati employee.

Not Joining Work
An administrative fine of Dh20,000 shall be applied for each Emirati employee if the beneficiary did not join work after a permit is issued and the company fails to report it.

Establishment Reporting
An administrative fine of Dh20,000 shall be applied for each Emirati employee if the establishment fails to report to Nafis that a beneficiary has stopped working.

Candidates Appointment
If the company breaches its obligations to appoint the candidate after the end of the Nafis-backed training without an excuse accepted by Nafis, the company shall return the support amounts paid during the trainings period.

Employee Benefits Change Reporting
If the company fails to inform Nafis of any change in the employee's benefits without an excuse accepted by Nafis, an administrative fine of AED20,000 for each case will be applied, as well as freezing the employee's financial support and return of benefits.

An administrative fine of AED20,000 for each Emirati employee, as well as the suspension of benefits and a refund of the amounts disbursed to the company if the employee benefitting from Nafis does not come to work and the company does not inform Nafis about it.
